Job summary

The Privacy, Transparency & Trust (PTT) Sub-directorate is a sub-directorate of the Delivery Directorate. The mission of the PTT Sub-directorate is to enable NHS England to drive innovation and improve lives through greater use of data and technology and to be a well-run organisation.

The PTT Sub-directorate will enable and promote public trust in NHS England's custodianship of staff, workforce and patient data. This aligns with the new legal duty of NHS England to have regard to the need to respect and promote privacy of patients and the core principles that underpin NHS England as a safe haven of patient data.

The IG Lead role provides professional expertise, experience and leadership within the PTT Sub-directorate.

Main duties of the job

The post holder will work in a dynamic team in delivering an effective service providing senior professional expertise to support NHS England programmes achieve their aims ensuring that IG is an enabler and embedding good practice.

Leading activities and workstreams using highly developed problem-solving, leadership and communication skills. Drafting key IG documents, including supporting the creation of Directions which are issued by DHSC to NHS England. Communicating effectively with colleagues who are not specialists in IG and raising awareness of IG across the organisation. Supporting and advising on the use of personal data; risks, mitigations, and requirements of DPIAs. Responding to statutory requests for access to personal data and exercise of other rights under the UK GDPR and DPA 2018. Advising on the application of the FOI Act 2000 or Environmental Information Regulations 2004. Advising on legal bases for sharing personal data with other organisations and the required documentation to facilitate such sharing, including advising on data processing agreements and data sharing agreements, identifying most appropriate controller / processor for processing activities in complex data flows. Identifying IG compliance and operational risks and issues, advising on mitigations and escalating where appropriate. Producing reports and KPIs to evaluate the organisation's compliance with IG requirements.

Colleagues with a contractual office base are expected to spend, on average, at least 40% of their time working in-person.

Qualifications

Essential

Post-Graduate level qualification / equivalent experience: Educated to Post-Graduate degree level (in a relevant subject) or equivalent relevant experience within a professional working environment. Graduate level qualification / equivalent experience: Educated to Graduate degree level (in a relevant subject) or equivalent relevant experience within a professional working environment. IG accredited qualification: Accredited IG specific qualification (but not limited to) BCS, ISEB, PDP, IAPP.

Desirable

Other relevant accredited qualification: Accredited qualifications which would materially benefit the performance of your role such as qualifications in project management ( Agile, Prince II), technology (such as advanced level user of Microsoft Office365), security, communications, or leadership.

Knowledge

Essential

The role requires extensive knowledge and understanding of data protection law, common law duty of confidentiality, NHS legal framework, the statutory functions of NHS England, ethical issues, and how they impact NHS England's use of personal data. Extensive knowledge of guidance and policy published by the Information Commissioner's Office (ICO), the National Data Guardian (NDG), NHS Records Management Code of Conduct, and other bodies. Extensive knowledge of how to apply relevant legal and policy IG requirements in practice. Extensive understanding the respective accountabilities and responsibilities for overseeing and managing IG issues, including the roles of the Caldicott Guardian, Senior Information Risk Officer, Data Protection Officer, Chief Information Security Officer, and Information Asset Owners.

Ethics in health data use: A good understanding of the ethical issues which impact our use of patient data, including internal and external re-use of data for different purposes and sharing patient data with others for the purpose of research and analysis, including individual's rights to opt-out provided by law and through policy. Health and social care system: Knowledge of the health and adult social care system in England, including organisations which comprise the NHS, different healthcare settings and the operating business model which support the delivery of health and adult social care services and the roles and responsibilities of the Department of Health and Social Care, its executive agencies and non-executive arm's length bodies.

Experience

Essential

Comprehensive experience of working in an information governance / privacy / data protection role. Comprehensive experience in writing key information governance documents, including IG policies and procedures, data protection impact assessments, privacy notices, briefings, advice notes, reports; including director reports and briefings. Comprehensive experience of providing clear and practical IG advice within tight timeframes in a range of formats tailored to the audience. Such advice may be required with considerable urgency on highly complex and high-profile matters which necessitates deep concentration for extended periods of time. Delivery of the advice may be required in person necessitating travel and physical attendance at meeting locations. Comprehensive experience in effectively communicating key IG issues and raising awareness across the organisation and conducting IG Research. Comprehensive experience of advising on sharing personal data with other organisations and the required documentation to facilitate such sharing, including advising on data processing agreements and data sharing agreements, identifying most appropriate controller / processor relationships for different processing activities in complex data flows. Comprehensive experience in identifying IG, compliance and operational risks and issues, identifying and advising on the most appropriate mitigations in line with the organisation's risk appetite and escalating where appropriate.

Desirable

Experience of working in a health and / or social care organisation. Experience in leading on negotiating effective resolutions to IG related issues both internally and with external organisations. Experience in creating and delivering an effective IG strategy within a large organisation which performs highly complex data processing.
